Terms and Conditions — Sala del Trading

These Terms govern your use of Sala del Trading services, provided by Henry Lucena ("the Provider", "we"), which include:

  • Everywhare app (iOS / Android) with trading signals and MT5 execution.

  • Élite community on Circle (monthly subscription).

  • 1:1 Mentoring ("Trading Rentable en 4 Semanas").

  • Website saladeltrading.com.

By creating an account or acquiring any of these services you accept these Terms in full. If you do not agree, do not use the services.

1. ⚠️ Financial risk warning — read this first

Leveraged trading in financial markets (forex, indices, stocks, commodities, cryptocurrencies) carries a high risk of loss and may not be suitable for all investors. You may lose all or more of the capital deposited in your broker account.

We are not financial advisors. Our services provide technical analysis, trading education, and automated signals as reference and educational tools. They do not constitute personalized investment advice, financial advice, or recommendations to buy/sell financial instruments.

You decide each trade. You are solely responsible for your investment decisions and for any outcome, positive or negative. Past performance of signals or mentoring does not guarantee future results.

We have no advisory relationship with you. We do not know your personal financial situation, risk tolerance, or objectives. Before trading, consult a financial advisor registered in your jurisdiction.

2. Service description

2.1 Everywhare app

Mobile application that:

  • Detects trading opportunities (signals) using technical algorithms (ICT/SMC, multi-timeframe analysis).

  • Displays signals with entry price, Stop Loss (SL), Take Profit (TP), and a technical quality score.

  • Allows execution of orders in your connected MT5 account, manually or automatically.

  • Maintains a historical record (Journal) of signal performance in R-multiples.

2.2 Élite community on Circle

Access to a private space on Circle.so with:

  • Live market analysis and discussion.

  • Daily NY session live trading.

  • Q&A with Henry and the community.

  • Educational resources.

2.3 1:1 Mentoring

"Trading Rentable en 4 Semanas" program:

  • Individual mentoring sessions.

  • Personalized trader development plan.

  • Access to program educational material.

2.4 What the services do NOT include

  • Personalized financial advice.

  • Management of your broker account.

  • Performance guarantees.

  • Deposits or withdrawals at the broker (handle those directly with your broker).

3. Account and eligibility

To use our services you must:

  • Be 18 years of age or older.

  • Have legal capacity to enter into contracts in your jurisdiction.

  • For Everywhare app: have an active account with a compatible MT5 broker (currently Vantage).

  • Provide truthful information when registering.

You are responsible for the confidentiality of your session and for all activity conducted with your account.

4. Subscriptions and payments

Plans

  • Élite Signals — USD 100/month: Everywhare app + Circle community access.

  • Élite Auto — USD 150-200/month (planned): + advanced auto-execution.

  • 1:1 Mentoring — price communicated upon enrollment.

Payment processing

Payments are processed by external providers (Stripe, Whop, or others integrated as appropriate). Your card data never passes through our servers.

Renewal and cancellation

  • Subscriptions auto-renew at the end of each period.

  • You can cancel anytime from your user panel or by emailing saladeltrading@gmail.com.

  • Cancellation takes effect at the end of the current paid period.

  • Refunds: within the first 5 days from your first subscription payment you may request a full refund. After 5 days, no refund for the current period, except as legally required.

5. Order execution in the app

When you execute an order from the app:

  • The order is sent to your MT5 account via our engine.

  • The broker is the final authority on acceptance or rejection. They may reject due to insufficient margin, closed market, unavailable instrument, etc.

  • We do not guarantee execution, slippage, fill price, or that TP/SL will be reached.

  • The lot size is calculated automatically based on your configured risk percentage and the balance your broker reports.

You are responsible for monitoring your broker account directly. The app is an auxiliary tool, not a substitute for direct control over your account.

6. Auto-execution

If you enable "Copy signals automatically" in Everywhare, you explicitly accept that:

  • Every new signal detected will be sent automatically to your broker without your prior confirmation.

  • The decision to keep the switch enabled is solely yours.

  • If signals produce losses while enabled, you are solely responsible.

You can disable the switch at any time. Pending orders in the broker remain alive until you cancel them or they expire.

7. Élite community — conduct rules

By participating in Circle you agree to:

  • Respect other members (no harassment, offense, or discrimination).

  • Not share content (messages, signals, resources) outside the community.

  • Not promote other products / services without authorization.

  • Not use the community for illegal or fraudulent activities.

Violations may result in suspension or expulsion without refund.

8. No availability guarantee

Services are provided "as is". We do not guarantee:

  • Uninterrupted availability.

  • Absence of errors.

  • That signals or classes will be profitable.

  • That the execution engine is always online.

  • That the app works on every device / OS version.

  • That Circle is operational 24/7.

We may suspend services for maintenance, vendor failures (broker, hosting, Supabase, Circle, etc.), or force majeure events.

9. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for financial losses arising from use of signals, order execution, application of educational content, investment decisions, technical failures, vendor errors (broker, cloud infra, Circle), or fortuitous events.

  • Our total liability to you, for any claim, shall not exceed the amount paid for subscription or mentoring in the 3 months prior to the claim.

  • We are not liable for indirect damages, lost profits, lost opportunity, or moral damages.

This limitation does not apply to damages caused by our willful misconduct.

10. Acceptable use

You agree NOT to:

  • Use our services for activities illegal in your jurisdiction or ours.

  • Attempt to hack, reverse-engineer, or scrape data en masse from the app, site, or Circle.

  • Share your account or credentials with third parties.

  • Operate on behalf of another person without legal authorization.

  • Use signals on public copy-trading platforms without written authorization.

  • Resell, redistribute, or sublicense access to any of the services.

We may terminate your account for breach, without refund.

11. Intellectual property

All service content (algorithms, code, design, "Sala del Trading" trademark, "Everywhare" trademark, signals, analysis, mentoring material, Henry's Circle messages) is owned by Henry Lucena or his licensors.

You hold a limited, personal, non-transferable license to use the services while your account is active. You have no right to copy, redistribute, sublicense, or commercially exploit the content without written authorization.

Signals and educational material you receive are for your personal use. You may not resell them, redistribute in paid groups, or run copy-trading based on them without a prior agreement.

12. Modifications to the Terms

We may modify these Terms at any time. Material changes will be communicated in-app, in Circle, or by email at least 7 days in advance. If you continue using the service after that date, you accept the new Terms. If you disagree, you may cancel your account.

13. Termination

Either party may terminate the relationship at any time:

  • You: from Settings (app) / user panel (Circle) → Close Account, or by emailing saladeltrading@gmail.com.

  • We: with or without cause, giving reasonable notice, except in case of serious breach (where termination is immediate).

Upon termination, you lose access to the services. Provisions on limitation of liability, intellectual property, and governing law survive termination.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Argentina. Any dispute shall be submitted to the ordinary courts of the City of Buenos Aires, with express waiver of any other forum.

15. Notices and contact

Legal and operational communications: saladeltrading@gmail.com.

In-app, Circle, or push notifications are deemed validly delivered when displayed on your device or account.

16. Severability

If any clause is held invalid or unenforceable, the remaining provisions remain in force. The invalid clause will be replaced by the legal provision closest to its original intent.

17. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the use of Sala del Trading services. They supersede any prior agreement, written or oral, on the same subject.
